These terms apply to FoodSussed, including its web tracker and Android app. FoodSussed is provided by Keith O'Beirne, trading as No Nonsense Fitness, in Ireland ("we", "us" or "our"). By using FoodSussed, you agree to these terms. If you do not agree, do not use the app.
1. What FoodSussed does
FoodSussed lets you log food, scan barcodes, search food data, photograph ingredient lists or labels, and view estimates and personal tracking information. Processing Levels are estimates drawn from ingredient lists using a NOVA-informed method. They are not an official NOVA classification, a health score, medical advice or a diagnosis. FoodSussed is for general information and personal tracking only.
FoodSussed does not replace a GP, dietitian or other qualified professional. Speak to an appropriate professional about a medical condition, pregnancy, breastfeeding, an eating disorder, or any concern about your health or diet.
2. Your account and content
You are responsible for keeping your account credentials secure and for the information you add to the app. You must provide accurate information where it is needed to run the service. You may export or delete your account using the app controls or request help through the Help form.
You keep ownership of the photos, food details and other content you submit. You give us the limited permission needed to process that content to provide FoodSussed, including optional photo scanning and product-detail submissions you choose to send. Do not upload content you do not have the right to use.
3. Premium, trials and Google Play
Premium features, trials and prices are shown in Google Play at purchase. Current list prices may include £8.99 monthly or £69.99 yearly in the UK, and €9.99 monthly or €79.95 yearly in euro countries. A 7-day trial may be offered where Google Play shows one. Prices, currency, tax and availability can vary by country and can change before purchase.
Google Play handles billing. If you start a subscription, it renews unless you cancel it through Google Play before the relevant renewal date. You can manage or cancel a subscription in Google Play. Refunds are handled under Google Play's refund policies and applicable consumer law. Deleting FoodSussed or deleting your account does not itself cancel a Google Play subscription.
4. Fair use and acceptable use
FoodSussed Snap has fair use of 50 Snaps a week. Barcode scanning is unlimited. We may apply reasonable technical limits to protect the service and other users.
Do not misuse FoodSussed: do not interfere with the app, attempt unauthorised access, bypass limits, upload unlawful or harmful content, infringe another person's rights, or use the app to provide services to others without our permission. We may suspend or end access where reasonably necessary to protect the app, users or our legal obligations.
5. Food information and availability
Food information, barcode matches, nutrition figures and estimates can be incomplete or out of date. Recipes, labels and product availability change. Check the pack, portion and current product information before relying on an entry. We may change, improve, pause or withdraw features when reasonably necessary.
6. Liability
We provide FoodSussed with reasonable care and skill. To the fullest extent allowed by law, we are not liable for indirect or consequential loss, loss of profits, loss of data where you have not used available export or backup options, or decisions made using estimates or food information in the app. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.
7. Privacy
Our FoodSussed Privacy Policy explains how we process personal data. It is not replaced by these terms.
8. Changes and law
We may update these terms when the app or legal requirements change. The revised date will appear above. If a change is material, we will take reasonable steps to bring it to your attention before it applies where required.
These terms are governed by Irish law. If you live in the UK or another country, you keep any mandatory consumer protections and rights to bring proceedings that cannot be excluded by agreement. For questions, use the Help form.
